三、教學目標 Objectives
本課程以講授中國大陸民法總則為主，課程涵蓋五編共計十三章:第壹編民法總則概述(第一章:民法與民法總、第二章:民事法律關係及抽象規則、第三章民法結構與民法總則)、第貳編法律關係主體(第四張:自然人、第五章:法人、第六章:非法人組織、)第三編法律關係客體(第七章:民事法律關係客體、第八章:物)、第肆法律關係內容(第九章:民事權利予以物、第十章:民事法律行為、第十一章:代理、第十二章:民事責任、第十三章:訴訟時效期間、除斥期間與其間計算)，透過輔以相關案例方式講授中國大陸民法總則相關法律規定、司法解釋、學說理論等內容，期能建立學習中國大陸民法領域知識之基礎。
This course is mainly to lecture the general provisions of the civil laws of People’s Republic of China. The scope of course cover five parts, total in 13 chapters: part 1: general provisions (chapter 1: civil laws and general principles, chapter 2: relationship and abstract rules of civil laws, chapter 3: structure and general provisions of civil laws), part 2: main body of legal relationship (chapter 4: natural person, chapter 5: legal person, chapter 6: unincorporated organization), part 3: objects of legal relationship (chapter 7: objects of civil laws relationship, chapter 8: superficies), part 4: content of legal relationship (chapter 9: civil rights over the superficies, chapter 10: civil legal behavior, chapter 11: agency, chapter 12: legal responsibilities, chapter 13: calculation of prescription and extinctive prescription). The related cases are supplemented to lectures of laws, juridical interpretations and theories regarding general provisions of civil laws of the People’s Republic of China. It is expected to seize the general theories and rules of the civil laws to establish the foundation of learning knowledge of civil laws of the People’s Republic of China.
