三、教學目標 Objectives
修讀本課程同學大多數是在行政機關、司法機關、律師事務所或企業從事法務相關工作。本課程將以案例分析方式引導探討「依法行政」和行政法院法官「依法審判」的理論與實務。
公務員要依法行政，不是有法可依即足，必須在符合法治國原則之下的依法才是真正依法行政。本課程將以法治國為主軸，分別介紹「正當行政程序」、「法之安定性原則」、「信賴保護原則」、「法律不溯及既往原則」。本課程要教導各位如何操作依法行政，更要溯源地引導同學研討依法行政的憲法基本原理「自由民主憲政基本秩序」。本課程最大特色就在於引導同學分析司法官、大法官歷年解釋建構實質意義法治國原則後再學習如何精緻操作「合憲的依法行政」。
Most of the students in this course are engaged in legal affairs related work in administrative agencies, judicial agencies, law firms or enterprises. This course, through case studies, will guide our discussions of the theory and practice of "administration according to law" and "judgment according to law" by judges of administrative courts.
Civil servants must carry out their duties according to the law, but it is not sufficient to merely follow the law. There will be genuine “administration according to the law” only when its execution conforms to the principle of the rule of law. This course will take the rule of law as the focal point to introduce "due administrative procedures", "principle of stability of law", "principle of trust protection", "principle of non-retroactivity of law". This course teaches how one is to operate administration according to the law, and further guides students to study retrospectively the basic principles of administration according to the law in the constitution, "the basic order of freedom, democracy and constitutionalism." The most important feature of this course is to guide students in the analysis of how interpretations by judicial officers and justices over the years has substantiated the principles of the rule of law before learning how to delicately operate "constitutional administration by law".
