| 本學期課程涉外民事爭端解決研究（二）課程，將介紹跨國民商事糾紛之程序，以比較法之方法，研究訴訟、仲裁程序法部分之管轄權、證據調查程序、陪審團、判決之承認與執行，及部分實體法之訴因、損害賠償等問題，期能提供參與同學對跨國訴訟相關議題之整體性認知。 |

| This course of SEMINAR ON CIVIL DISPUTE RESOLUTION INVOLVING FOREIGN ELEMENTS (II) will introduce the students to the proceedings of resolving cross-border civil and commercial disputes. Further in-depth exploration into the contexts of judicial and arbitral processes from the viewpoint of comparative studies. More procedural than substantive aspects will be introduced in regards to jurisdiction (internet/cyber), discovery, evidence collection and imaging as well as recognition and enforcement of foreign judgment, etc. We will try to focus on the practical issues and difficulties which involve the representation of international clients in resolving trans-border disputes. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
