| 由醫護與基因科技之快速發展所帶動之後生物科技時代(post biotechnology era)引發了傳統社會 面對新興科技與醫療行為的法律因應，以及社會價值的重行詮釋等新興卻迫切需要處理的議 題。「科技相關法律問題專題研究（二）」此課程，係針對醫護科技發展與應用所可能涉及的法 律與倫理等問題予以探討，使同學能夠對醫護科技涉及的法律結構、法學理念、倫理問題及我 國現行相關法制有一整體性的認知，以奠定此議題法學研究的啟發基礎。 | ||||||||||||||||||||||||||||||||||||||||||||
| This subject is taught by way of the introduction of the basic law to let the students to understand the whole outline of the construction of law，the virtue of the jurisprudence and the present law in Taiwan. It begins as the teaching of the concept of the medical justice and is succeeded by introducing the medical law，the institution of the medical law，the responsibility and litigation as well as the medical liability of the member of medical society to ensure the students to know the exact concept of the law. It also teaches the students to use the comparative study method to understand the update development of the medical law such as the law issue of the surrogate mother，the tube baby，the sperm bank，the law of AIDS and so on，which can open the mind of the students' studying interest. | ||||||||||||||||||||||||||||||||||||||||||||

| ●整體敘述 Overall Description ﹝一﹞緒論。 ﹝二﹞生與死的醫護法律問題。 ﹝三﹞醫事人員法制。 ﹝四﹞新藥試驗研發的法律倫理問題研討。 ﹝五﹞人體試驗的法律倫理問題。 （六）醫學科技與法律倫理。 ﹝七﹞醫事常見法律問題。 （八）基因治療的法律問題（包含：1、基因治療的概念、爭議性及基本規範；2、基因隱私權、 基因資訊權；3、基因治療的法益權衡和保護模式；4、、基因人格權、基因財產權等。）。 ﹝九﹞新醫學科技之發展與法律倫理專題研討。 |
