三、教學目標 Objectives
這門課主要介紹轉型正義的理論,包括全球轉型工程、實踐、反思及規範。課程主要探討以下問題:
什麼是轉型的正義?
為什麼會以「轉型」及「正義」兩個概念來命名「該如何處理及反思過去政權的人權侵害」?
轉型正義的工程及形式有哪些?
各國轉型正義的實踐有哪些?
對轉型正義的時間有哪些批評性的反思?
聯合國有何相關轉型正義的準則和規範?
為什麼轉型正義必須關注性別及原住民的議題?
臺灣的轉型正義有哪些問題?
南韓與台灣轉型正義各有何共同及特殊之處?
藉由這些問題的討論來釐清:正義、人權、可咎責性、真相、有罪不罰、和解、賠償、性暴力等概念在轉型正義方面的應用與修正。
This seminar will introduce the theories of transitional justice, including global transitional justice mechanisms, practices, critical reflections and norms. Following questions are matter for the seminar:
What is "transitional justice"?
Why the two terms, "transitional" and "justice" are combined to address atrocities and mass human rights violations of the past regimes?
What are forms or practices of transitional justice?
What are norms and critical judgments of the practices?
Why gender and indigenous issues relevant to transitional justice?
What are problems of Taiwan's seeking justice for the 228 Incident and White Terror?
What are common and specific features of transitional justice in South Korea and Taiwan?
Following concepts will be clarified regarding transitional justice readings and discussions: justice, human rights, accountability, truth, impunity, reconciliation, compensation.
四、課程內容 Course Description
整體敘述 Overall Description
本課以「誰是加害者?」為研究的核心,探討貫穿轉型正義政治工程中,加害者的多元面貌,包括涉及審判、真相委員會、賠償、除垢或清洗、制度改革等探討中所呈現的加害者、加害組織、人權侵害模式及如何究責等問題。台灣轉型正義工程最少觸及加害者及其責任問題,對加害者概念的複雜度、組織性的加害模式及不同層次責任問題缺乏深入的探討。

"Who are the perpetrators?" is the leading question of this seminar. The multiple faces of perpetrators in trial, truth commission, reparation, lustration and institutional reform studies would be the target of the investigation, including their representations, systems and institutions, models of human rights violation, and how their responsibilities should be addressed. Taiwan's transitional justice engineering focuses rarely on the perpetrators and their responsibilities. The complexities of perpetrator's concept, the systematic violation of human rights by the state, and the distinctive responsibilities are less investigated.
