三、教學目標 Objectives
國際貿易法涵蓋的範圍十分廣泛，其規範的項目大約可分為三大類： 第一類處理國際經濟貿易法律之建置及執行；第二處裡政府與政府間的經貿法律關係；第三類則處理政府與民間私人企業間的關係；第三類則是處理民間企業間的法律關係。 在第一類的法律關係中，最重要的是以世界貿易組織的各項協定(WTO)為主題的法律關係。近幾年來雙邊及區域自由貿易協定(FTA)的興起，特別是巨型FTA也發展出新的政府間規範。此外，政府間所簽署的投資協議亦應屬於本議題之範圍。由於國際經貿關係瞬息萬變，國際經貿法律也面臨極大之挑戰，隨著國際經貿情勢的變化，數位時代的來臨，全球環境日益惡化，都使得大家必須重思國際經貿法律的調整及建置。 本課程的主要目的是在討論當下WTO所面對的問題、各主要FTA的內容及投資協定之發展，教學方法將著重在討論各項法律規範之內容以及如何運用各項規範處理特定問題。 教學目標將著重在培養同學從國際經貿現勢及WTO相關案例之討論及分析、觀察國際經貿法律對國際經貿情勢發展間之連動關係。
International trade law covers very broad and extensive topics which can generally be classified into three categories: The first category deals with the legal relationship between different governments. The second category deals with matters between government and private businesses. The third category deals with legal issues between private businesses. In regards to the first category, agreements established under the framework of the World Trade Organization provide the foundation that governs the relationship between different governments. The recent trend of entering into bilateral and multilateral free trade agreements, including investment agreements signed by governments, has also established new rules governing the economic and trade relationship between signatories. The main purpose of this course is to discuss the content of various WTO agreements and major Free Trade Agreements and to learn the skills to effectively apply the rules and terms to advocate on behalf of the signatory party being represented. Classes discussion will focus on interpretation of the agreements and application of the relevant rules and terms in specific cases.
