三、教學目標 Objectives
1.培養必備之物權法基礎知識，使同學通曉擔保物權法之基本概念及其內在價值，從而具有問題發現及解決能力。擔保物權是資本市場推動經濟發展之一隻手，若能充分運用，必有助於企業資金之籌措，經濟之發展。其中普通抵押權、最高限額抵押權及權利質權最具潛力。

2.理論及實務兼顧，深化同學之物權法基礎知識，訓練其應用能力，以瞭解物權法於社會生活之實際運用。故運用實例、法院之實務見解，使物權法之學習具體化、生活化，體驗現實世界物權法所扮演之功能。例如擔保物權不僅是確保債權實現之手段，更重要的是企業融資之重要方法，企業若具備將固定資產轉化為流動資金之能力，並以最佳條件獲取資金，應是在扁平世界中勝出競爭的必要條件。
1.This course is aimed at students to establish essential foundation of the Property Law and in particular to understand basic concepts and inner values of Security Interest System and the Law for being able to discover and solve disputes and problems. Because Security Interest System makes it necessary for the capital market to promote economic development, it is also helpful for industries to use the system properly to set up funds. In the field of Security Interest System and the Law, General Mortgages, Line of Credit Mortgages and Pledge of Rights are most central issues to be discussed in the future.
2.The course also puts an equal emphasis on theoretical and practical perspectives to help students deepen their knowledge of Property Law and build up their capability to use it in real-life society. The course will discuss cases and courts’ opinions to help students have a whole picture of Property Law and experience its functions in daily life. For example, the Security Interest System is not only to method to ensure repayment of a debt, but also for industrials to transform fixed properties into funds. Therefore, how to raise funds in best conditions by using this system is necessary for industrials to stand out in such intense competition of the plain world.
四、課程內容 Course Description
●整體敘述 Overall Description
期中考前為普通抵押權。重點在（一）擔保物權及抵押權之意義、特性、運用；（二）普通抵押權之效力（抵押物之範圍、抵押權與擔保物用益權之利益調整關係）；（三）普通抵押權之效力（包括普通抵押權之次序、處分及保護等問題）；（四）普通抵押權之實行，此涉及實體法、非訟事件及強制執行程序之交錯運用，流抵約款等私實行程序之重要問題；（五）抵押權實行後，物上保證人之求償權及承受權。共同抵押權改採調整主義後所面臨之複雜問題。
期末考前為（一）最高限額抵押權：此項抵押權是理財型融資之重要擔保手段，具有低成本、高效率及一定獨立性之優勢，為社會大眾所最愛用。（二）質權：動產質權雖因信用卡等金融商品之發達而式微，但仍屬占有擔保物權之基本型；又權利質權則具有扮演非占有擔保物權之相當功能，應係中小企業融資之最佳擔保手段，其未來於金融市場之角色不可忽視。（三）不動產役權多樣並且變化多端，具有以最小成本，提升不動產經濟效率之重要功能，自應善加利用。
