三、教學目標 Objectives
訓練出具有獨立思考能力的法學人才，所學的知識足以應付司法考試及未來的工作需要。
This course aims to provide a liberal education in the theory and practice of “Succession” Part of the ROC Civil Code (art. 1138-1225). Proposal for further reforms is suggested. The core topics included in this module are: 1. the order of succession and legal shares of heirs, 2. forfeits of right to inherit, 3. restitution claims as an heir, 4. estate property, 5. co-inheritance, 6. limited succession waived for inheritance, and mandatory unlimited succession, 7. unacknowledged succession, 8.wills, 9. compulsorily reserved shares.

●整體敘述 Overall Description 第一講：繼承制度與繼承權之根據； 第二講：繼承人之資格、種類、順序、法定應繼承、代位繼承； 第三講：繼承權之喪失； 第四講：繼承回復請求權； 第五講：繼承之標的、繼承之費用與遺產酌給請求權； 第六講：遺產之公同共有與債務之繼承； 第七講：遺產分割之限制、遺產分隔之方法； 第八講：分割之實行； 第九講：分隔之效力； 第十講：限定繼承； 第十一講：拋棄繼承與強制包括繼承； 第十二講：無人承認之繼承； 第十三講：遺囑能力與遺囑之方式； 第十四講：遺囑之撤回； 第十五講：遺囑之執行； 第十六講：遺贈； 第十七講：特留分與扣減權；
