三、教學目標 Objectives
憲法是規定國家和人民之間的基本權利義務、國家基本組織和職權、以及國家基本國策的根
本大法,惟因憲法條文多係扼要、概括、抽象及彈性的文字,要掌握憲法保障人民基本權利
的真義,必須了解憲法的基本原理。另國家權力組織之設計,在形成負責任的政府,以促進
人民利益,故國家體制之良窳,影響人民權益至深且鉅,故亦有需要了解政府體制之設計原
理。本課程將配合實際案例講解,期使同學透過憲法基本原理與政府體制設計原理,充分了
解我國憲法條文及政府體制之優劣得失。
The Constitution is a set of fundamental principle that defines a state's structure, the rights and obligation of people and the state, as well as nation's basic policy. However, the articles in the Constitution consist of abbreviate, abstract and generalised wordings, therefore it is necessary to understand the basic principle of the Constitution in order to capture the true meaning of people's rights.The purpose of a state's power design is to form a responsible government that promotes and protects people's interests. Therefore it's also important to understand how the state is structured because a well designed state system can have great effect on people's right. Students will understand the pros and cons of our current Constitution articles and current state structure through the studies of fundamental constitution principle, government design priciple as well as case studies.
