三、教學目標 Objectives
Course Objectives

To familiarize students with the fast growing Law of International Institutions which, although weak and nonbinding in many areas, have already impacted upon international community since early 20th century, and even more so since 1945. This course covers its historical developments since late 18th century incluidng, but not limited to, LON, UN, specialized agencies affiliated with the UN, and regional organizations. Emphasis will always be on both theory and reality, since law does not exist in a vacuum. Finally, the participation of Taiwan in world organizations will also be discussd due to its very unique international standing and various subtle factors.

International affairs from 2017-2021 have gone through interesting and drastic developments. Global pandemic of COVID-19 since late 2019 has victimized more humans than the 1918 flu, and devastated the whole world. New US President, US Senate, and new US Congress certainly have to face the most challenging situations for at least two more years (2021–2022). Global leaders and observers are watching closely. The good news is that various vaccines are being administered throughout most countries of the world by late-2021, and yet vaccines disparity in the world is still to be addressed.
Course Objectives

1. a. Introduction and approaches ( institution vs. case; law vs. sword; and theory vs. pragamatism)
b. Suggested Itinerary for Travel around Taiwan by Train in 5-7 Days
2. Origin and historical development
3. League of Nations, its operation and why it failed
4. Founding of the United Nations
5. Membership of international organizations ( full member, associate member, observer, non-state entity )
6. Legal status of international organizations ( legal capacity and its limits, capacity to conclude treaties, diplomatic or functional protection, capacity for diplomatic representation
etc.)
7. Basic structures and organizations ( Assembly, Council, Secretariat, Professional and Judicial body, Subsidiary organ )
8. Rules of Procedure ( balance between sovereign equality and functional necesssity in its decision-making process, unaminity or majority rule, weighted voting, consensus without vote )
9. Veto in the UN Security Council ( origin, opposing views, double veto and reality )
10. Privileges and immunities of international organizations ( practical necessity and legal justification, UN Charter and Headquarters Agreement, privileges and immunities of the UN, UN Specialized Agencies, range of entitlement from UN Secretary General to international public service )
11. United Nations in general ( from LON to UN, purposes and principles, six main organs )
12. UN General Assembly and Security Council ( nature, powers and functional evolution, paralyzed SC reasserting its powers after the end of cold war )
13. Specialized Agencies of UN ( reasons for existence, different approaches to international issues, classification ), category A.
14. Specialized Agencies, categories B, C, and D
15. Overall evaluation of the UN
16. Regional Organizations ( OAS, OAU to AU, EU etc; )
17. International standing of the ROC ( Taiwan ) and prospect of its rejoining international organizations ( covering origin of the Chinese Representation Question in UN, comments on GA Resolution 2758 ( XXV ), is PRC justified in claiming sovereignty over Taiwan ? Is ROC ( Taiwan ) a State ? observer status for Taiwan in WHA, May 2009-2012, Can UN intervene if PRC attacks Taiwan ? etc.)
