三、教學目標 Objectives
原住民族傳統智慧創作保護條例自96年底制定公布後，迄110年底已有81件原住民族傳統智慧創作完成登記程序，獲得專用權利。這項參照著作權法基本概念為基礎之原住民族傳統智慧創作之保護制度，為各方所不熟悉。事實上，包括原住民族在內之各界，對於既有智慧財產權制度與原住民族傳統智慧創作之保護，其相互影響與協調發展，均有諸多不理解。
本課程以原住民族歷史地位為出發點，探討原住民族權益，再進入智慧財產權法制，以國際智慧財產權論壇之討論方向為依據，兼顧憲法、原住民族基本法、文化基本法、文化資產保存法及文化創意產業發展法之精神，以原住民族傳統智慧創作保護條例及其相關子法為核心，一方面關注原住民族傳統智慧創作保護之文化權相關議題，另方面也分析原住民族傳統智慧創作專用權之財產權相關議題，期盼學習者帶動我國原住民族傳統智慧創作保護之觀念提升及落實實務。
本課程始於原住民族委員會106年度至109年度補助辦理「原住民族傳統智慧創作保護人才培育」計畫下所開設之課程，隨後成為法學院每學年單一學期經常性持續開設，第110學年度更與通識課程之「原住民族傳統智慧創作及文化保護」課程上下學期對開課程，供對此議題有興趣之校內外學生選修，是一門認識原住民族權益、現代智慧財產權法制與原住民族傳統智慧創作保護所生衝擊與協調之重要課程。
There has been 81 traditional intellectual creations of indigenous peoples completed registration and got legal protection since the Protection Act for the traditional intellectual creations of indigenous peoples was promulgated in 2007. Most of the people are not familiar with this special legal regime. Actually, even the indigenous peoples also do not understand both of the systems of modern intellectual property rights and of the traditional intellectual creations.

This course invites many important lecturers, respectively, to make presentations concerning international intellectual property rights, constitution law, foundation law of indigenous peoples, Cultural Heritage Preservation Act and Law for the Development of the Cultural and Creative Industries. This course will focus on the protection for the traditional intellectual creations of indigenous peoples on the one hand, and assist indigenous peoples to apply registration of its traditional intellectual creations.

This course is very important for the understanding of the conflict and harmonization between modern intellectual property rights and of the traditional intellectual creations. It is sponsored by the Council of Indigenous Peoples with 2017 government budget and will continuously provide for any interested student inside or outside of campus.

本課程將使學生對憲法、原住民族基本法所關切原住民族之基本人權、文化權有深入體會，明瞭原住民族傳統智慧創作於與現代智慧財產權法制之互動關聯與保護不及之處，能善用文化資產保存法及文化創意產業發展法，並正確認知原住民族傳統智慧創作保護條例及其相關子法之規定，落實原住民族傳統智慧創作之保護。
