三、教學目標 Objectives
讓學子能意識到過去的法律規範、法律制度或法律思想，對於眼前的法文化仍有抽刀斷水的關聯性；歷史告訴我們，傳統與當代並非那麼地涇渭分明，也沒有所謂的楚河漢界；傳統既是一宗包袱，也是一筆資產。如果，我們不對過去的法文化作一番深入的考察與評價，便無法理解中華法系是如何從傳統過渡到近現代，也就不能從中得到一些有益的借鏡與啟示，更不能為未來的法制改革獲得先機。
In order to let the students to realize the legal norms, legal systems or legal thoughts of the past are still relevant to the current legal culture; history tells us that the tradition and the contemporary are not so distinct, and there is no so-called Chuhe-Han boundary. The tradition is both a burden and an asset. If we do not make an deep examination and evaluation of the past legal culture, we will not be able to understand how do the Chinese legal system looks like.
If the system transitions to modern times, it will not be able to get some useful wisdom of experiences and inspirations from it, and it will not be able to gain opportunities for future legal reform.
四、課程內容 Course Description

本課程採取「輕其所輕、重其所重」的教學方式，有選擇性的集中講述十多個重要課題，自先秦以迄民國，以「歷史時期」區分為經；從法律規範、法律制度、法律思想到法律意識乃至司法實踐，以「問題導向」解析為緯，兼採「變」與「不變」的靜態與動態的觀察法，期能既通達也能扼要，尤盼有助於提升年輕學子的法學人文素養。
