三、教學目標 Objectives
一、透過講解及分析，使學習者暸解信託法立法當時之原則與價值選擇，並透過歷史分析，瞭解我國信託法繼受問題與特有問題。
二、透過講解及分析，使學習者暸解我國信託法適用時與民法等其他法律交互影響產生之相關問題，以培養處理信託法與民法等其他法規相互交錯時之處理能力。
三、闡述當前信託法立法之國際趨勢，例如美國、日本、香港及中國大陸等信託法制提出比較，並探討國際趨勢下對於我國信法之影響，使學習者能對信託法有更深層之體認。
四、針對現行實務上信託業者所辦理之不同類型信託，例如不動產信託、預收型信託等分別介紹，配合實例及實務應用解說，使學習者能將法規與實務運作相結合，以瞭解信託法於實務規劃之應用與相關問題。　
1. Through the explanation and analysis, the instructor enable learners to understand the principles of trust law legislation at the time of the choice and value, and to understand our successors Trust Law Problems with the peculiar problems by historical analysis
2. In order to have the interleaving processing capabilities , students understand the related issues when they apply Trust Law, and know the interactions of Civil and other Laws by instruction.
3. This class tries to introduce current trends of elaborate international trust law legislation, such as the rule of law trust the United States, Japan, Hong Kong and mainland China. We compare and explore international legislation trends on trust laws, so that students can have a deeper knowledge on th body of trust laws.
4. The current practice for the trustee to handle different types of trusts, such as the real estate trusts, trusts and other advances are introduced, with examples and real applications. The students can combine the operation of legislation and practice. Make students to understand the applications of trust law practice planning and related issues.
四、課程內容 Course Description
●整體敘述 Overall Description
為培養學習者深入瞭解及其應用信託法，本課程依時序及學習項目可區分為下列幾個部分：
一、信託之起源與意義：
就英美法系信託與大陸法系信託信託綜合探討，包含英美法系信形式所有權與實質所有權之雙重所有權概念與大陸法系下一物一權與債物權分離原則調和之探討及信託為債權行為或物權行為之研討。
二、我國信託法之基本規定與相關問題：
瞭解信託之定義、消極信託、信託之性質與功用、信託財產、信託之效力、信託委託人、信託受託人、信託受益人、信託監察人、信託關係之變更與消滅、公益信託等基本規定，並瞭解其相關問題，特別是與民法等其他法律交互影響時所產生之相關問題。
三、信託法之國際趨勢：
美國、日本、香港及中國大陸等信託法制提出比較，並探討國際趨勢下對於我國信法之影響，使學習者能對信託法有更深層之體認。
四、信託相關實務簡介：
就目前國內外之信託業務，例如不動產買賣價金安全交易信託、預售屋價金與不動產開發信託、禮券預收款信託、保險金信託等，就信託法之應用提出討論，並兼論信託稅制對於信託業務之影響。

課程分配，「信託之起源與意義」及「我國信託法之基本規定與相關問題」為基本觀念培養階段，占課程內容80％，「信託法之國際趨勢」及「信託相關實務簡介」為進階學習應用占20％，故以「信託之起源與意義」及「我國信託法之基本規定與相關問題」優先，其次因目前信託法之應用均以營業信託為主，故次就「信託相關實務簡介」提出講述，最後為理論與實務併用，就「信託法之國際趨勢」提出介紹。
