三、教學目標 Objectives
本學期憲法專題研究以「基本權利的保障與限制」為主題，探討的對象包含憲法學理與相關司法院解釋，除了探討個別不同的基本權利保障，主要焦點在於自由權與平等權，並結合憲法第二十三條基本權限制的限制條款，尤其是其中三個原則：法律保留原則、目的正當性原則與比例原則，結合審查密度理論，進一步探究基本權利限制的合憲性。並比較美國聯邦最高法院所發展的三重審查基準。修課同學可以從本課程學習自由權與平等權保障的學理之外，亦可學習到如何運用於實務憲法問題的解決。
This course concentrates on the constitutional protection of constitutional rights and its relation to judicial review. It studies the relevant constitutional doctrines and constitutional adjudications about different kinds of basic rights, mainly rights against the state's constraining (the so called freedom-right) and right of the equal protection. In order to review if the official limitations on basic rights of any kinds can be constitutionally justified, it is to make use of article 23 of the Constitution that includes three principles: Principle of Legal Reservation, Principle of Justified Purposes, and Principle of Proportionality, combined with Theory of Review Intensity. It is also beneficial to compare those with the Doctrine of Three Levels of Scrutiny developed by the US Supreme Court.
