三、教學目標 Objectives
本課程為憲法之深化，提供學生一個「國家組織法」之釋憲審查目錄，學習如何將所學的「國家組織法」運用在憲法實務上。課程中，會同時就當前憲法學術與實務上之若干重要課題，以專題方式論述，藉由國內相關專業論文章與大法官解釋的相互印證，深化同學憲法關於「國家組織法」部分之法實務與學理的基本知識。並培養同學未來面對「國家組織」之憲法爭議的解決問題的能力。
By way of the introduction of the theory of national organization. On the important topics of the current constitutional academic and practical issues, it is discussed in a special way. Through the mutual confirmation of the relevant domestic monograph articles and the interpretation of the judges, the basics of the law and practice of the "national organization law" part of the students' constitution are deepened. Know how. And to train students to face the problem of solving the problem of constitutional disputes of "national organization" in the future.
四、課程內容 Course Description
●整體敘述 Overall Description 憲法法律關係中，在國家基本價值秩序下，主權者人民與國家權力間的法律關係以及國家權力彼此間的法律關係該如何被解構與結構？又在面對一個具體與國家組織有關之案件該如何解析？違憲審查之審查目錄又為何？本課程從形式合憲性與實質合憲性兩個思考步驟出發，先分析憲法文意義上的權限分配；進而就自由國原則（基本權保障、民主國原則、法治國原則、社會國原則與地方自治的制度性保障逐一分析，以提供學生學習具體解決「國家組織法」相關憲法問題之基本能力。
