三、教學目標 Objectives
本課程係針對具涉外因素的民商事事件，探討有關其國際裁判管轄權與準據法的決定，以及內國法院應如何承認與執行外國法院的判決等。希望藉由基礎原理的講授與實例的分析，幫助同學瞭解我國涉外民事法律適用法的具體內容，以及國際民事訴訟法理論與涉外商務仲裁等制度。
This lecture will focus on the civil cases with foreign factors to discuss the decision of their international jurisdictions/governing laws and their recognition/enforcement in the Taiwanese court. This lecture will help the students to understand the substances of the application of international private law and the theory of international civil procedure law and foreign arbitration.
四、課程內容 Course Description
●整體敘述 Overall Description
本課程之教學重點在於從訴訟程序到選法理論的體系整合，課堂中除對於涉外民事法律適用法的條文解釋外，並將輔以檢討我國現行實務判決，以期使同學們了解涉外民商事紛爭的全貌。第一學期將先針對國際私法的基礎原理（總論）以及國際民事訴訟程序的相關理論加以介紹。第二學期則就各論部分之條文逐一介紹。
