四、課程內容 Course Description
●整體敘述 Overall Description
人民因公務員之違法行為而受到損害時，得向國家請求損害賠償，
乃為現代國家憲法所保障的基本人權之一，憲法第 24 條
規定：「凡公務員違法侵害人民之自由或權利者，除依法律受懲戒外，
應負刑事及民事責任，被害人民就其所受損害，並得依法律向國家請
求賠償。」此即為憲法對人民自由權利保護之事後救濟或保障的基本
規定，蓋憲法對於人民權利保障之規定，故甚為詳盡，然均為事前保
障之性質，如不附以強而有力之事後保障，則憲法上有關人民自由權
利之事前保障規定，恐難得實效，是以，憲法第 24 條規定人民因公
務員違法侵害其自由權利就其所受損害得依法律向國家請求賠償，此
之所謂「依法律」即係依據「國家賠償法」。國家賠償法第 1 條規定：
「本法依中華民國憲法第二十四條制定之。」。本課程據此研習國家賠償法的整體制度內涵與個別法條之構成要件適用問題。
