| 本門課程將以行政法總論中比較重要之內容, 如行政處分, 行政命令, 行政罰, 行政契約, 行政調查, 行政執行, 行政救濟及國家責任等, 選擇較有意義之案例, 進行研析. 其中除詳述各種學說見解外, 亦參照我國大法官解釋, 行政法院裁判及行政機關之實務態度，並引介先進法治國家之經驗, 共為借鏡. 期藉由案例之研析, 使同學了解該行政法制度應有之內涵以及我國在相關立法、裁判及行政實務上之缺失，得以強化同學在行政法方面之基礎, 有助於日後對於各種行政法專業領域之深入學習。 | ||||||||||||||||||||||||||||||||||||||||||||||||
| This course will focus on the more important content in the general theory of administrative law, such as administrative sanctions, administrative orders, administrative penalties, administrative contracts, administrative investigations, administrative execution, administrative relief and state responsibility, etc., select more meaningful cases and conduct research and analysis In addition to detailing various theories and insights, it also refers to the interpretations of our country’s chief justices, administrative court judgments and the practical attitudes of administrative agencies, and introduces the experience of advanced countries under the rule of law, which are all for reference. | ●整體敘述 Overall Description 本課程將擇定數個重要行政法上制度, 如行政處分, 行政命令, 行政罰, 行政契約, 行政調查, 行政執行, 行政救濟及國家責任等, 再於該制度之範圍內提出相關之案例, 於課堂上講解並討論. 由於各種制度涵蓋範圍不一, 案例之複雜度亦有不同, 故難以明確地界定課程進度. 此外, 課堂上除由老師提出案例講授外, 並鼓勵同學參與討論或提出個人見解, 期能以較積極的態度進行本課程, 俾充分發揮學習之效果. |
