三、教學目標 Objectives
引導同學認識法理學，培養法律思辨、法理分析與解釋的能力。

四、課程內容 Course Description
●整體敘述 Overall Description 法理學（又叫法哲學），是對法律的思辨（對應英文”philosophy of law”, “legal philosophy”, or “jurisprudence”），探討法律規範的基礎與原理，為法律的後設研究。法律經常更迭、修訂或廢止，對於立法、行政及司法的問題討論，均與法律規則和原則的思辨有關，法理學對此提供基本理論與思考。 近年方法論的精進，促使法理學內容愈趨專精和艱奧，但根本問題是不變的。法理學要探討的基本「問題」–(1)「法律是什麼？」為關於真實性問題（questions of truth），也就是實然的問題；(2)「法律應該是什麼？」為關於法律的價值問題（questions of value），也就是應然的問題；(3)「為什麼案件這樣判？」為關於法律規範性問題（questions of normativity），涉及判例及判準形成的問題。 法理學是一門歷史悠久的學問，有不同發展階段及學派理論，依照研究「方法」來區分，法理學大致分為三類：分析法理學、規範法理學、批判的法理論（analytic jurisprudence, normative jurisprudence, critical theories of law）。最為人熟知的自然法理論（natural law theories）及分析法實證主義（analytical legal positivism），為針對法律概念及方法的研究，屬於分析法理學。規範法理學，是以特定倫理學立場進行研究，例如探討法律應如何保障勞動與工作權、墮胎應否合法化、為防止疫情擴散應否禁止集會、國家應否歸還原住民族土地、推動轉型正義的合法性、政府徵收人民土地的正當性、刑罰是否公平等等。批判的法理論，則是針對現實中的法律（法律的預設、知識型、價值等）進行描述與批判，例如批判法學運動及女性主義法學等。 這門法理學的入門課程，將引導同學認識法理學，教師將引介法理學的簡史、代表學說、重要觀點，並帶入議題討論，培養同學具備基礎知識與運用的能力。每週預定上課進度，由教師講演當週主題，同時搭配指定閱讀教材，與同學討論內容疑難。
