本課程除為使學生習得、理解美國憲法上值得我國借鏡之處外,並期待學生能化抽象為具體,實際應用憲法的理論於日常生活可見的案件中。 | ||||||||||||||||||||||||||||||||||||||||||||||||
In the second semester, we will deal with the due process of law and equal protection issues and you are supposed to learn the subjective analysis. | ||||||||||||||||||||||||||||||||||||||||||||||||
四、課程內容 Course Description | ||||||||||||||||||||||||||||||||||||||||||||||||
●整體敘述 Overall Description This course will focus on four topics: separation of powers, freedom of speech, due process, and equal protection. I may change the topics in order to discuss the events occur from time to time. We will hold a moot court as always. For the students who substantially participate the moot court, your final exams will be exempted and graded on the basis of the performance during the moot court. Other students still be will required to take a final exam. The textbook for this course is “Constitutional Law”, Sullivan & Gunther, 16th edition. As much as I would like to use Professor Presser’s textbook, it appears that too much history data in his amazing book would not assist you in this early stage. I will not ask you to buy the textbook since I will post the main cases on your website. Please keep a close eye on the syllabus for your class readings. You are required to read the assignments for each class and brief the cases for the purpose of class discussion and the midterm & final exam. I will highly suggest that you should prepare your own briefs before each class and outlines for each exam. The evaluation will be as follows: 35% midterm exam, 35% final exam; 30% in-class participation. Midterm & Final Exam: Modified open book, around 100 minutes. You may bring my ppt and your own notes, briefs, and outlines for the exams. You have to write a memo for each exam. I think I will ask you to write objective memo(s) for Fall Semester and subjective memo(s) for Spring Semester. In-class participation: I take your absences, briefs and volunteer answers seriously. I will appreciate your class participation since this is the core of Socratic method, which is pervasively used in the U.S. law schools. I will explain more in class. As to the absences, please note that if you are absent more than 3 times in my class, you will absolutely fail this class. One more time, I am serious about your absences. |
