三、教學目標 Objectives
本課程將以全英語授課之方式介紹美國憲法。兩學期的課程中將透過以下四個主題之呈現探討當代憲法議題:權力分立、聯邦主義、平等保障、正當程序條款。修課者將了解憲法之演化過程並最終習得以下能力:辨識憲法案件中具體爭議、連結爭議與相關憲法理論與原則規範,並形成自己之論點。修課者也將透過課程學習批判性閱讀(聽講),深入分析及流暢論述等法學教育基本能力。
This course provides an introductory review of American constitutional law. In these two semesters, contemporary constitutional issues will be discussed in the setting of four major themes: separation of powers, federalism, equal protection, and the due process clause. Students will understand the law’s evolution and further possess the abilities of defining issues in a constitutional case, associating them with relevant theories, doctrines and rules, and finally comprehend them to form their own arguments. Students will also sharpen their skills of critical reading (and listening), thoughtful analysis, and articulate synthesis, all of which are fundamental to their legal education.
