三、教學目標 Objectives
本課程以案例解題方式，配合債編總論範圍，旁及與債編總論相關之財產法(例如債編個論或物權等)有關內容，設計為十二個專題，全程以PPT教材實施授課如下:專題一、債、債權、請求權；專題二、債之發生:(一)契約、(二)代理權之授與；專題三、債之標的；專題四、債之對內效力(一)債務履行、(二)債務不履行:1.給付不能2..給付遲延3.受領遲延4.不完全給付5.給付拒絕；專題五、債之對外效力；專題六、契約之效力(一)一般之效力、(二)特殊之效力；專題七、多數債權人與債務人(一)可分之債與連帶之債、(二)不可分之債；專題八、債之移轉(一)債權讓與、(二)債務承擔；專題九、債之消滅(一)清償、(二)抵銷；專題十、無因管理；專題十一、不當得利；專題十二、侵權行為:(一)一般侵權行為、(二)特殊侵權行為。預期透過案例教學使同學學習案例分析能力，並能將所學相關法學知識運用於案例題之解題。
The class adopts case study in line with the scope of general provisions of obligations and collaterally refers to Property Act in related with general provision of obligations (e.g. the kinds of rights in rem in kinds of obligations). There are 12 topics delivered via PPT as follows: topic 1. Obligations, creditor’s rights, claims; topic 2. Sources of obligations: (1) contract, (2) conferring of authority of agency; topic 3. Object of obligations; topic 4. Internal effects of obligations (1) performance of obligations, (2) default on obligations; topic 5: external effects of obligations; topic 6. Effects of contract (1) general effects, (2) special effects; topic 7. Plurality of creditors and debtors (1) divisible and joint obligations, (2) indivisible obligations; topic 8. Transfer of obligations (1) Credit Assignment, (2) undertaking of obligations; topic 9. Extinction of obligations (1) performance (2) offset; topic 10. Management of affairs without mandate; topic 11. Unjust enrichment; topic 12. Torts: (1) general torts, (2) special torts. It is expected to have students develop the analytical ability through case study and apply the knowledge of laws learned to solve the case.

出席 5%為鼓勵同學出席上課，採行不定期點名方式，凡點名有出席者，酌予加1-5分。加分未滿者，其餘分數併入期中考及期末考成績範圍計算。
期中考 55%期中考採行筆試方式評量成績。但若遇疫情等特殊情況，得以繳交報告方式代筆試。
學期考 35%學期考採行筆試方式評量成績。但若遇疫情等特殊情況，得以線上考試或繳交報告方式代實體筆試。
課堂討論 5%為鼓勵同學在課堂上踴躍發言，以同學發言情況，酌予加1-5分。加分未滿者，其餘分數併入出席加分或期中考及期末考筆試成績範圍計算。
