三、教學目標 Objectives
本門課程主要以行政法之總論為範圍，本諸已學習之憲法理論，著重於行政法基礎理論之解說， 並引介先進法治國家之經驗，建立同學日後研習行政法各論之基礎。 此外參照我國大法官解釋及行政法院裁判，檢討目前行政機關之實務， 使同學了解行政法應有之內涵以及我國在相關立法、裁判及行政實務上之缺失， 掌握未來我國行政法發展之趨勢，並有利於日後學習行政法之各種專論。 Based on the lessons of Constitution Law, we emphasize on the general part of Administrative Law. We also introduce the practical legal experiences of advanced nations, to establish the participators’ basement to future research of different kinds of administrative law areas. We also reference interpretations of Justice of the Constitutional Court, and Judgments of Supreme Administrative Court. In order to build and strengthen understanding of administrative law and be able to grasp the trend of future.

四、課程內容 Course Description
●整體敘述 Overall Description 1.原則上由老師於課堂上依講義內容講授，並提出問題討論。 2.上學期著重於(1)行政法之理論基礎:包括行政之概念、行政法之概念、行政法之法源、行政法上之法律關係及行政裁量等。(2)行政組織法:包括行政組織之基本概念、行政組織之結構、行政機關之種類及管轄、公物及公務員法等。 3.下學期則以行政作用法為主，包括行政命令、行政處分、行政契約、事實行為、行政罰及行政執行等。 4.由於本科目課程內容太多，有關行政救濟及國家責任部分，因本系已另行開設選修課程，請同學另行選讀，不在本課程之講授範圍。
