三、教學目標 Objectives
本課程旨在使學生認識美國聯邦藍能法(Lanham Act)及相關習慣法(Common Law)原理原則。重要議題包括商標權之要件、註冊、侵權及其抗辯、相關理論基礎，以及近期焦點，例如網域名稱、減損識別性與信譽、商業言論自由等。
This course will introduce students to the federal Lanham Act and related common law doctrines. In addition to the requirements for trademark protection, registration, infringement, and defense to infringement, this course will discuss the theoretical underpinnings of trademark protection and evaluate current issues in trademark law including domain names, dilution, and speech rights.
