三、教學目標 Objectives
針對下列內容進行介紹，使修課同學對憲法有基礎性之掌握： 一、憲法在我國法制中所扮演之角色與地位。 二、權力分立架構下之國家機關之組織與權限劃分。 三、基本權利之主客體、類型及其功能。 四、各個基本權利之意義、保障範圍及國家於限制基本權利時所應遵循之界限。
By introducing the following contents, the purpose of this class is to allow the enrolled students to have a basic understanding of the Constitution: 1. The role and status of the Constitution in Taiwan's legal system. 2. The organization and authority division of state organs under the principle of power separation. 3. The subject and object, types, and functions of fundamental rights. 4. The meaning and scope of each fundamental right and the boundaries that the state should follow when restricting those rights.
四、課程內容 Course Description
●整體敘述 Overall Description 憲法為一國之根本大法，其規範包含了國政體、領域、人民的權利義務、國家基本組織及其權限、中央與地方權限劃分、基本國策以及憲法修改程序等內容，憲法不但為人民權利的保障書，更為一國之發展方向定其基調，其重要性不可言喻。本課程將以中華民國憲法本文及增修條之介紹為本，並輔以具有活憲法之稱，得補充憲法內涵之司法院大法官相關解釋，作為主要之課程材料。以期中考為分界，前段課程除引導學生理解憲法之基本概念、原理原則外，將重心置於內容較為具體之國家機關組織與權限；後半段則進階至規範內容較為抽象之人民基本權利保障部分，針對基本權利的功能，以及個別基本權利保謢範圍、限制、與其他基本權利間之衝突與競合等，配合相關釋字及理論與實務不同見解進行介紹。
