三、教學目標 Objectives
本課程目標在使同學了解民事法律體系之基礎規範模式，並自此出發，銜接與民法其後各編之學習，暨面對新科技衍生相關實務問題之應用的思維、討論能力，讓學習者面對現今靈活的考試與職涯趨勢應對，能有更充分而紮實的預備。
This course aims to enable students to understand the general system of Civil Code and basing on this, facilitates them learning the methodology to apply provisions in other four parts of the Code appropriately. In particular, the course emphasizes that learners should apply academic knowledge to solve problems; meanwhile, through the adequate and flexible preparation students may transfer smoothly into professional career in the future.
四、課程內容 Course Description
●整體敘述 Overall Description 民法是所有民事法律之基本，而民法總則更是民法五編及其他民事特別法之原理原則。民法總則主要的內容在於確立私法的價值理念，包括民法上的基本概念之形成，與體系邏輯構造。本課程一學期共四學分，學期授課範圍包括:民法第一編總則之第一章「法例」（§1-5）、第二章「人」（§6-65）、第三章「物」（§66-70）、第四章「法律行為」（§71-118）、第五章「期日期間」（§119-124）、第六章「消滅時效」（§125-147）、第七章「權利之行使」（§148-152），內容重點則包含權力分立與法源、法律的基本概念與現代民法、權利義務與基本原則、法學方法與法律適用、權利主體、權利客體、法律行為的基本概念與要件、意思表示、代理、無權處分、消滅時效等。本課程將運用基礎之法學研究及實務處理方法，結合法規、實務案例與時事詳加說明。
